Genius of the week nominee
Enter Jarek Molski. If any of you know this guy, smack him around a bit. In reality, it probably wouldn't do any good, and you would probably end up with a lawsuit yourself.
Winery will face ADA suit again
It seems that Mr. Molski was in an accident a few years back and as a result of it he ended up with some things he didn't have before.
1. A wheelchair.
2. All sorts of free time.
Running a quick 'google' on this dude showed that plenty of people eiter know who this guy is or have gotten a call from his lawyer. I came across this response from The Hitching Post in Casmalia, CA. From the piece:
Further snooping around the web yielded this site:Frizzen Sparks. From all indications, this is not exactly a 'fan site' for Mr. Molski, but all sorts of people seem to know who he is. I offer a warning about the language...not necessarily 'G'-rated.

"Jarek Molski will seek unspecified monetary damages from a Templeton winery even though a federal judge dismissed an Americans with Disabilities Act suit last week without awarding money, his attorney said Tuesday."That's right, the case has been thown out once already. And while this one in particular in focused on Peachy Canyon Winery, it appears that it's more like Molski vs. The Businesses of California.
"Molski, a 34-year-old Los Angeles County man who was injured in a 1988 motorcycle accident, has filed some 400 ADA suits in federal court -- including more than 50 against San Luis Obispo County businesses."400 individual lawsuits? I know that California has some issues when it comes to things politic, but what the hell is this? Is there not some of 'Three strikes and yer out' policy for litigation? I am in no way denegrating the importance of accessability for the disabled, but this is insane. Just so you know, some P.O.S. unloaded on a very close friend of mine while said P.O.S. was trying to rob a restaurant in Louisiana. In doing so, my friend took 7 rounds and is now in a wheelchair for the rest of his life. It's one thing to have something like that happen to you and be forever pissed at the world, it's quite another to misread a turn on your crotch rocket and then take it out on every popsicle stand in the state. Admittedly, I don't know the details of his accident, but sooner or later, enough is enough.

"In March of 2004 we received a phone call from our attorney notifying us that the Hitching Post Restaurant was being sued by a disabled man named Jarek Molski. Mr. Molski apparently visited our restaurant in March of 2003, had drinks and dinner and left without a word to anyone that he had trouble accessing our facility. His lawsuit asks for $4000/day since March 2003 until such time as we settle with him. As of November 15, 2004 that figure is approximately $2.4 MILLION! News flash for Mr. Molski: We’re not settling!"$4000 a day?!? Wow. And you thought the interest rate on those parking tickets was bad. How about this? Why doesn't someone file a lawsuit against Peachy Canyon Winery for 'excessive' use of the word 'peachy'. I'm sure at one point or another there was a peach tree planted somewhere near here. And the name, in and of itself, is not all that much to deal with. But looking at their website shows a severe lack of imagination with headers like 'Peachy Wines' and 'A Peachy Philosophy'. I have no idea what it is to be 'peachy' but if someone responded to my inquiry 'How are you doing today?' with something like 'Just peachy', I would probably punch them in the neck. And I'm from Georgia, a.k.a. 'The Peach State'.

That bastard put that scam on some wineries out here in little Livermore Valley. He brought a lot of pain to these wineries for no apparent reason pissing off a LOT of people in the town... smack him around indeed though I agree, it probably won't do much good...
